AInara PLATFORM PRIVACY POLICY

In compliance with the provisions of the EU Regulation 2016/679 General Data Protection Regulation (GDPR) and the Organic Law 3/2018 on the Protection of Personal Data and guarantee of digital rights (LOPDGDD) we inform you of the processing of your data through this platform based on AI technologies.

No personal data of users will be used for AI training or for purposes other than those indicated in this policy.

Categories of data

In our operations we process user data (including administrators), usually basic identification data.

In this platform we collect data from these people over 18 years of age who have signed up for the platform:

• Administrator users: the people with the role of administrator and with the possibility of granting access to other users by managing the client-account.
• Platform users: the people using the platform who search for content and generate their own content.

Our agreements are made with educational entities, publishers, public and private institutions and schools.

Purpose

Personal data will only be processed for the purpose of managing your contractual relationship with us, providing necessary service and supporting the platform.

We will use the platform usage data, the contents and searches consulted and the subjects of such searches for analytical purposes and with anonymized information. We are not interested in knowing who searches what but whether there are general patterns of content searches that can help us to expand and/or improve the service.

No search data will be stored in the sense that if the user includes personal data in the prompts, such data will not be used either for SMILE & LEARN’s own purposes or to train the platform.

The user is responsible for the content they upload, but SMILE & LEARN will not use it. For more information, please consult the terms of use of the platform.

Legitimation

In the case of users, we base the data processing on the execution of the contract and the provision of the platform’s services.

If we perform analytics of our services, we will do so based on our legitimate interest, although we will always avoid using non-anonymized personal data.

Recipients

Personal data will only be used by our company although we work with providers and tools that provide us with certain types of ancillary services and that can access this data.

Our servers (Amazon Web Services) are located in the territory of the European Union.

The AI tools we use are versions that guarantee closed environments in which the contents of the searches are not going to be used to train the models.

Some of the tools we use in our company may be located outside the European Union but we have verified that all of them have adopted the appropriate compliance measures as required by the GDPR (standard contractual clauses, among others):

We will not transfer or communicate your data to third parties except for the fulfillment of legal obligations to which we are obliged by reason of our business (Public Administrations, financial institutions, insurers).

Security

Smile and Learn has adopted all technical and organizational security measures necessary to ensure the confidentiality, integrity and availability of personal data. These measures take into account the current standards of technology, the costs of implementation and the nature, scope, context and purposes of the processing carried out, as well as the risks in terms of probability and severity to the rights and freedoms of natural persons.

The user is responsible for their own credentials and for the proper use of the platform.

Rights

We inform you that you may at any time exercise your rights of access, rectification, portability and deletion of your data as well as those of limitation and opposition to their processing. If you consider that the processing does not comply with current data protection regulations, you have the right to file a complaint with the supervisory authority (Data Protection Agency).
